WASHINGTON – The United States is currently weathering an institutional crisis and an assault on the democratic framework that is “different in kind and scope to anything I’ve seen in my lifetime.” The stark warning was delivered by former Special Counsel Jack Smith, the prosecutor who led the federal indictments against Donald Trump following his first presidential term.
In an exclusive interview with the television network MS Now, Smith launched sharp criticisms against the current Trump administration, asserting that the Justice Department (DOJ) has been restructured to a point where federal courts can no longer rely on its institutional integrity.
The Erosion of Professional Expertise Inside the DOJ
According to the former special counsel, deep structural changes within the department have severely crippled the efficiency of the American legal apparatus. He emphasized that the systematically forced departure of seasoned career professionals could have catastrophic repercussions for national security.
“They’ve jettisoned expertise. We have a situation where we’ve got rid of people who know how to protect our national security,” Smith warned, adding that dedicated career prosecutors are being “demonized” and politically targeted simply for executing their constitutional duties.
Smith pointed out recent operational friction in Minnesota, where federal prosecutors openly revolted against politically driven directives, refusing to target family members of shooting victims during aggressive immigration crackdowns carried out by Immigration and Customs Enforcement (ICE).
Consequences of Presidential Pardons and Electoral Warnings
A major point of concern highlighted by Smith involves the blanket presidential pardons granted to individuals convicted in the January 6, 2021, assault on the U.S. Capitol. He argued that reversing these convictions not only introduces a direct risk of criminal recidivism but also delivers a deeply damaging message to federal law enforcement agencies.
As a direct result of these shifting dynamics, the former prosecutor expressed deep anxiety over the integrity of the upcoming midterm elections. He cautioned that the factions responsible for orchestrating the events of January 6 have likely analyzed their past failures to execute more sophisticated strategies in future cycles.
Justice Directed by “Predetermined Outcomes”
Reflecting on his own 2023 legal filings against Trump regarding the attempts to overturn the 2020 election and the retention of highly classified materials, Smith maintained that his team utilized standard, rigorous federal investigative protocols with absolutely no political bias. Both historic cases were ultimately dissolved following Trump’s reelection, in accordance with long-standing Justice Department guidelines that prohibit prosecuting a sitting president, and after a federal judge dismissed the documents case.
Smith drew a sharp contrast between that baseline and today’s environment, which he described as driven by politically motivated agendas where “process doesn’t matter, and we just have to find a way to get to that outcome.” He specifically cited recent dismissed cases against former FBI Director James Comey and New York Attorney General Letitia James as examples of target-driven prosecutions handled by temporary appointments.
Finally, Smith revealed the extent of the administrative pressure surrounding him, noting that the Justice Department targeted his retained private legal counsel by stripping their security clearances immediately after their partnership became public. Despite these maneuvers, Smith stated he remains undeterred by the threat of potential reciprocal indictments and is fully focused on supporting the staff who served alongside him.
